Worked example — a ₹75 lakh flat in Vesu:

  • Male buyer: ₹3,67,500 stamp duty + ₹75,000 registration = ₹4,42,500
  • Sole female buyer: ₹3,67,500 stamp duty + ₹0 registration = ₹3,67,500

The myth we correct almost every week

Several online stamp duty calculators show 3.9% stamp duty for women in Gujarat. This is wrong, and buyers walk into our office having budgeted for it.

Here is the actual position: the stamp duty applicable in Surat is the same for both women and men — 4.9% of the property value, being the basic rate of 3.5% plus a surcharge of 40% on that, which works out to 1.4%. The registration fee is one percent of the property value, and it is this fee that is waived if a female owns the property.

So: no concession on stamp duty. Full waiver on the registration fee.

One more trap. Adding a male co-owner to the property nullifies the registration fee waiver for women, and the standard 1% registration fee applies. If you are planning to register in your wife’s or mother’s name to save the 1%, the deed must be in her sole name. Decide this before the sale deed is drafted, not at the SRO counter.


The 2026 jantri situation — read this before you fix your registration date

Jantri is the government’s minimum valuation for your locality. Also called the Annual Statement of Rates (ASR), it is the circle rate equivalent in Gujarat. No property in Gujarat can be registered below this value on paper — so even if you buy a flat for less than the jantri value, the government will still charge stamp duty on the higher jantri amount.

The timeline matters enormously right now:

  • April 2023 — the last major revision, after a 12-year pause. Rates nearly doubled in many areas.
  • November 2024 — the government announced a major hike, with some areas seeing valuations proposed at 5x to 2000x the 2023 rates.
  • 1 April 2025 — the planned rollout date. It was put on hold after the public and builders raised objections.
  • 2026 (now) — the new rates are still pending, and the government plans to roll them out in phases later this year.

What this means for you practically: the rate that applies is the one published on the day your document is registered — not the day you booked, not the day you paid your token. If the phased rollout lands in Surat while your registration is still pending, your stamp duty is recalculated upward on a flat you have already agreed to buy.

Documents you need to carry

From the buyer:

  • PAN card (mandatory — no PAN, no registration for high-value deals)

Two witnesses must be present with their own ID proof and photographs. Ask them a week in advance — this is the single most common reason appointments get wasted in Surat.

Step-by-step: the registration process in Surat

Step 1 — Verify the title and the jantri rate

Before any money moves, check the title chain and pull the current jantri rate for the exact survey number. The Garvi application lets you search property, get an Index-2 copy and document copy, and find the jantri rate.

Buying below jantri also creates an income tax exposure under Section 56(2)(x) — the difference between jantri value and your purchase price can be treated as income in your hands. Price the deal with that in mind.

Step 2 — Get the sale deed drafted

Have an advocate draft it. A sale deed carries the schedule of property, the consideration, the payment mode, the possession date and the indemnity clauses. Template deeds downloaded off the internet cause disputes years later, and the cost of a proper draft is trivial against the value of the flat.

Step 3 — Complete Public Data Entry (PDE) on Garvi

This is the part most buyers do not know they can do themselves. Garvi provides an online Public Data Entry facility through which the party can submit the details — party names, property details, stamp duty paid — to the Sub-Registrar Office for registration of the document.

Data entry is done by citizens themselves, from anywhere at any time, with no need to submit an input sheet of the document. It reduces time and increases accuracy. You will receive a PDE number — keep it.

Step 4 — Pay stamp duty and registration fee online

Pay through the e-payment facility linked to the Cyber Treasury. Applicants receive a 13-digit code upon payment of stamp duty and registration fees, and it is advisable to print and keep a copy of the e-challan for future reference.

Print two copies. Bring both.

Step 5 — Book your Sub-Registrar appointment

Garvi’s online appointment scheduler provides available time slots for document registration to the parties. Appointments are made from the Garvi home page by selecting the registration appointment scheduler for citizens.

Which office? Surat has multiple Sub-Registrar offices split by jurisdiction — the Surat City offices (including the well-known Athwa Gate / Nanpura office) and the Choryasi taluka office, which covers much of the newer south-west development belt. Your jurisdiction follows the property’s location, not your residence. Confirm the correct office when you book; showing up at the wrong SRO is a lost day.

Step 6 — Attend and execute

Buyer, seller and both witnesses attend in person. Biometrics, photographs and thumb impressions are captured. The Sub-Registrar verifies identity and the payment challan, and the document is registered.

Gujarat’s turnaround here is genuinely good — roughly 99.92% of documents are ordered on the same day on which they are presented, under a “No Documents Pending” policy across 294 Sub-Registrar offices in the state.

Step 7 — Collect your Index-2

The Index-2 is your proof of registration and the document every bank, society and future buyer will ask for. Download it from Garvi and keep both a digital and a physical copy. Register the mutation entry with Surat Municipal Corporation afterwards so the property tax record moves into your name.


Timing rules that catch people out

  • A document must be presented for registration within four months of execution under the Registration Act. Beyond that you are into delay condonation and penalty territory.
  • 1% TDS under Section 194-IA applies where the consideration is ₹50 lakh or more. The buyer deducts and deposits it via Form 26QB. Miss this and your loan disbursement or your deed can stall.
  • Stamp duty and registration charges are not covered by your home loan in most cases. Most lenders calculate eligibility based on the property’s cost excluding stamp duty and registration charges, so these need to be planned for separately. On a ₹75 lakh flat, that is ₹4.4 lakh of cash you need on top of your down payment.

What changes when the Registration Bill, 2025 becomes law

A national overhaul is close. On 27 May 2025 the government introduced the draft Registration Bill, 2025, which aims to replace the 117-year-old Registration Act of 1908 and bring land and property registration into the digital age.

The Bill allows for complete online registration — document submission, verification and issuance of digital certificates — with Aadhaar-based verification permitted with consent and alternative identity options also provided. It also makes registration mandatory for documents such as agreements to sell, power of attorney, sale certificates and equitable mortgage arrangements.

Public feedback closed on 25 June 2025 and enactment is expected in 2026. Gujarat is already ahead of most states on the infrastructure side, so implementation here should be quicker than elsewhere. We will update this guide when it is notified.


Frequently asked questions

Is stamp duty in Surat different from the rest of Gujarat? No. Stamp duty is a state-level levy — 4.9% applies across Gujarat, including Surat, Ahmedabad, Vadodara and Rajkot. What differs between cities and localities is the jantri rate the 4.9% is applied to.

Can I register a property in Surat entirely online? Not yet. You can complete data entry, payment and appointment booking online through Garvi, but physical attendance at the Sub-Registrar office for biometric verification is still required.
